These terms are maintained by the Swaption team. They explain how this app works in plain English. They are not legal advice; if you need a binding contract for your business, consult a lawyer familiar with your jurisdiction.
1. Who we are
Swaption ("we", "us") operates a peer-to-peer marketplace where individuals list items to sell or swap, chat about them, meet up or ship, and review each other. We are not a party to the transactions between members; we provide the platform.
2. Eligibility
You must be at least 16 years old and able to enter into a binding contract under the laws of your country. You agree to provide accurate account information and to keep your password confidential.
3. Account and security
You are responsible for activity under your account. Notify us immediately at security@swaption.app if you suspect unauthorized access. We may suspend an account if we reasonably believe it has been compromised, used for fraud, or used to violate these terms.
4. Listings and conduct
You may only list items you legally own and have the right to sell or swap. You must:
- Describe items honestly (condition, defects, photos of the actual item).
- Set a price you are willing to honor.
- Respect the prohibited items list.
- Treat other members with respect — harassment, hate speech, threats, and discrimination are not tolerated.
5. Buying, selling, swapping (SwapLock)
When two members agree on a deal, our SwapLock holds the transaction until both sides confirm the swap was completed. Either party may open a support ticket or dispute if something goes wrong. We may refund, release, or cancel based on evidence. Sellers receive payouts minus our platform fee, shown in the order summary.
6. Fees and taxes
We charge a percentage fee on completed sales (displayed before confirmation). You are responsible for declaring and paying any income or sales tax your activity may generate in your country.
7. Content licence
You keep ownership of the photos, descriptions and reviews you post. By posting, you grant Swaption a worldwide, royalty-free, non-exclusive licence to host, display, and share that content for the purpose of running the marketplace and promoting it. We will remove your content within a reasonable period after you delete your listing or account, except where we are required to keep it (e.g. dispute records).
8. Moderation and enforcement
We may, at our discretion, hide, remove, or restrict listings, messages, or accounts that violate these terms or the law. Serious or repeat violations may lead to permanent suspension. We use automated and human review.
9. Disclaimers
The platform is provided "as is". We don't guarantee that an item will sell, that another member will pay or ship, or that the platform will be uninterrupted. We are not responsible for the legality, safety, or quality of items listed by other members. Use common sense, meet in public, and inspect goods before handing over money.
10. Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim arising out of or related to your use of Swaption is limited to the fees you paid us in the 12 months before the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
11. Termination
You may delete your account at any time from your profile. We may suspend or terminate accounts that violate these terms. Some records (orders, disputes, tax info) may be retained for legal compliance for the periods set out in our privacy policy.
12. Changes to these terms
We may update these terms. Material changes will be notified by email and via an in-app notice at least 14 days before they take effect. Continued use of Swaption after that date means you accept the new terms.
