Swaption, LLC respects intellectual property rights and responds to notices of alleged infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512). Listings, photos, and messages on Swaption are posted by members, not by us.

What a takedown notice must include

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work you claim was infringed.
  3. The URL of each listing, image, or message you want removed, with enough detail for us to locate it.
  4. Your name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner's behalf.

Knowingly misrepresenting that material is infringing can make you liable for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f).

What we do

On receipt of a compliant notice we remove or disable the material expeditiously, notify the member who posted it, and give them a copy of the notice. Removed listings are logged for our records.

Counter-notice

If you believe your content was removed by mistake or misidentification, send a counter-notice to the address above containing: your signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief the removal was a mistake or misidentification; your name, address, and phone number; and your consent to the jurisdiction of the federal district court for your district (or, if outside the United States, the Middle District of Florida) and to accept service of process from the complaining party. We may restore the material in 10–14 business days unless the complaining party files a court action.

Repeat infringers & counterfeits

We terminate the accounts of members who are repeat infringers in appropriate circumstances. Counterfeit, replica, and unauthorized-reproduction listings are prohibited under our Prohibited items policy and are removed on sight.

Trademark and other rights

For trademark, publicity, or other non-copyright complaints, email admin@swaptions.net with the registration details, the URLs at issue, and a description of the violation.
